Ben & Jerry's has sued the company behind pornographic movie series "Ben & Cherry's" for infringing the names of its ice cream flavors.
The Vermont-based company, a subsidiary of Unilever NV, is suing producers Rodax Distributors and Caballero Video, saying "the sale of hardcore and exploitive pornographic DVDs and related goods is tarnishing Ben & Jerry's Homemade Inc.'s name by creating an association with pornography," the Associated Press reported.
In its lawsuit filed Wednesday in Manhattan federal court, Ben & Jerry's identified some of the XXX-rated video names similar to its own as being:
The New York Post pointed out that even Ben & Jerry's popular “Cherry Garcia” got renamed “Hairy Garcia” for a series of fetish films.
And "AmeriCone Dream" — inspired by satirist Stephen Colbert — "became the gay-themed 'Americone Cream.'"
The DVD jackets also mimic the packaging of Ben & Jerry's ice cream products, Reuters added, citing the lawsuit.
Ben & Jerry's wants to stop Rodax from making or selling movies that infringe its trademarks and is also seeking unspecified monetary damages.
The AP pointed out that Ben & Jerry's had itself used "racy names" for its ice cream flavors including Schweddy Balls and Karamel Sutra.
