Halle Berry wants restraining order against ex Gabriel Aubry

LOS ANGELES — Halle Berry is taking steps to protect her family by filing a restraining order against her ex, Canadian model Gabriel Aubry.

Aubry, who is the father of Berrry's 4-year-old daugher Nahla, allegedly started a fistfight with Berry's current fiance Olivier Martinez on Thanksgiving Day during a "custodial handoff" of Nahla.

TMZ reports that a judge issued an emergency protection order requiring Aubry to stay 100 yards away from Berry, Martinez and Nahla but the order expires on Tuesday.

Lawyers for Berry, 46, will head to court this week seeking a more permanent order.

The Los Angeles Times reports that Aubry is expected to appear in court on Dec. 13. Aubry was arrested on suspicion of misdemeanor battery after police were called to Berry's Hollywoood home on Thursday morning, Los Angeles Police Officer Julie Boyer told the newspaper.

Following the fight, Aubry, 37, and Martinez, 46, were both taken to Cedars-Sinai Medical Center with "non-life-threatening injuries".

Berry and her lawyers were reportedly alarmed that Aubry started the fight with Martinez in front of their child.

"If Gabriel can't control himself enough to protect Nahla from emotional trauma, it's too risky for him to be around her, Berry or Martinez," sources told TMZ. 

According to the Huffington Post, Berry has already been in court several times recently to address Aubry's temper.

Berry recently sought a court order allowing her to move to France with Nahla but a judge denied her request. Berry requested the order in February, arguing that she feared for her and her daughter's safety after being stalked by two men.

Aubry successfully argued that taking Nahla to France would be punitive and was designed to stop him from having contact with his daughter.
