CR describes the men’s court appearance: they were dressed in white, sitting in a row. KSM today looked like his father or grandfather, he’s aged. He was fairly articulate. He made it clear he does not accept the military-provided lawyer, that he does not accept the legitimacy of the military commissions. (How did KSM express himself and his co-defendants?) KSM and the first defendant were on the same note which is remarkable because they haven’t seen each other in nearly two years. KSM said the only law he acknowledges is Shariya Law. He condemned the US constitution and if need be he’ll be a martyr. (He was addressing the fact there that he could receive the death penalty?) Yes, it was an extensive exchange between the judge, the Marine Colonel, and KSM. The judge was trying to persuade him to accept the military lawyer assigned to him. (What else was said?) KSM said he wouldn’t mention the torture, I know where the red lines are and I won’t cross them. (What are the consequences of allowing a defendant like KSM to act as his own attorney?) The question is, if they don’t have a way to prepare a defense whether the prosecution would want to stick to its proposed trial schedule which is to open the trial on September 15th, right in the middle of the presidential campaigns.
